Customers of EOTS (User)

Limitation of Liability.   Under no circumstances shall EOTS, its affiliates, its licensors, its contractors or their respective employees be liable for any direct, indirect, incidental, special, punitive, or consequential damages that result in any way from User’s use of or inability to use EOTS or to access the Internet or any part thereof, or User’s reliance on or use of information, services, or merchandise provided on or through EOTS, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays, in access to, alternation of, or use of user’s account, whether for breach of contract, negligence or under any cause of action. In the event EOTS is found liable under any circumstance under the terms of the Terms of Service, EOTS’s liability shall be limited to the liability as stated in the Terms of Service.

Indemnifications of EOTS by User.   Upon request of EOTS, User agrees to defend, indemnify, and hold harmless EOTS, its affiliated companies, licences, agents, employees, and all their respective successors and assigns from all liabilities, claims, losses, judgements, damages, and expenses, including, without limitation, attorney’s fees and costs of litigation, arising from User’s breach of this Terms of Service by use of, or in connection with, the transmission by or through User’s account, of any Content or communications. This indemnification shall survive the termination of the Terms of Service.
